  • Cancellation takes effect at the end of the then-current billing period unless stated otherwise.
  • We may suspend or terminate paid or unpaid access at any time for policy, abuse, payment, legal, security, or operational reasons.

Generated Content and Intellectual Property

Your Content

As between you and us, and subject to applicable law and third-party rights, you retain whatever rights you may have in your lawful inputs and lawful outputs. We do not guarantee that any output is protectable, available for exclusive use, non-infringing, or suitable for commercial exploitation.

License to Operate the Service

You grant us a non-exclusive, worldwide, limited license to host, reproduce, transmit, process, review, moderate, analyze, cache, adapt, and otherwise use your inputs and outputs as necessary to operate, secure, maintain, enforce, troubleshoot, improve, and provide the Service, and to comply with law.

Platform Rights

The Service, including our software, workflows, models, interfaces, branding, documentation, and infrastructure, is protected by intellectual property and other laws. We reserve all rights not expressly granted in these Terms.

Data, Hosting, Availability, and Deletion

The Service may temporarily process, cache, host, transmit, or store prompts, uploads, outputs, links, and related metadata as necessary to operate, secure, maintain, support, moderate, investigate, or improve the Service.

We do not guarantee:

  • permanent hosting of any user content
  • continued availability of any generated media, files, records, or links
  • successful recovery of deleted, expired, disabled, or unavailable content

We may remove, disable access to, or delete prompts, uploads, outputs, generated media, hosted files, delivery links, history records, and related data at any time, with or without notice, including for operational, security, legal, policy-enforcement, abuse-prevention, storage-management, or business reasons.

Content that violates these Terms or that we reasonably believe creates legal, reputational, abuse, or safety risk may be removed immediately and without prior notice.

Privacy

Our collection and use of personal information is described in our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding privacy or data handling, the Privacy Policy will control for that subject matter.

No Pre-Screening Duty and Content Moderation

We may use automated tools, manual review, metadata analysis, abuse detection, or other moderation methods. However:

Our prohibited-content rules and reporting process are described in the Acceptable Use Policy.

  • we are not obligated to pre-screen any content
  • we are not obligated to monitor every use of the Service
  • we do not guarantee that any prohibited content will be detected, blocked, removed, or prevented

We may investigate suspected violations, preserve or review relevant records, and cooperate with law enforcement, regulators, courts, rights holders, or other authorized parties where we consider it appropriate or where required by law.

Reporting Prohibited Content and Takedown Requests

If you believe that content created, uploaded, hosted, or linked through the Service is illegal, violates our prohibited-content policy, depicts you without valid consent, or involves the sexual exploitation or abuse of an actual or apparent minor, please report it immediately to support@zimage.run.

Please provide the relevant URL, task or request identifier if available, a concise description of the issue, and a reliable way for us to contact you. Do not download, reproduce, or email suspected illegal media.

We prioritize reports involving child safety, non-consensual intimate imagery, sexual exploitation, trafficking, or immediate risk of harm. We will review ordinary prohibited-content reports within seven business days. Content confirmed to be illegal or otherwise requiring immediate removal will be disabled or removed without delay, and associated accounts may be restricted or terminated. A person depicted in content may request removal and review of the asserted consent. We may preserve limited records and report matters to competent authorities where required or appropriate by law.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ANY WARRANTIES REGARDING:

  • accuracy, legality, reliability, quality, safety, or appropriateness of any output
  • uninterrupted availability, security, or error-free operation of the Service
  • compatibility with your intended use, workflow, device, or jurisdiction
  • non-infringement, merchantability, fitness for a particular purpose, or results obtained from use of the Service
  • moderation effectiveness, filtering accuracy, or successful prevention of prohibited content

AI-generated output may be inaccurate, offensive, biased, misleading, unlawful, infringing, or otherwise unsuitable. You are solely responsible for evaluating outputs before use.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Z-IMAGE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • indirect, incidental, consequential, special, exemplary, or punitive damages
  • loss of profits, revenue, business, goodwill, data, content, or opportunity
  • content deletion, link expiration, storage loss, or inability to recover content
  • third-party dissemination, reposting, embedding, mirroring, or misuse of user content or outputs
  • claims based on user inputs, user outputs, or downstream use of generated media
  • failure to detect, block, or remove prohibited or harmful content
  • service interruptions, security events, bugs, outages, infrastructure failures, or third-party service failures

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Z-Image and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your use or misuse of the Service
  • your inputs, uploads, prompts, source files, or outputs
  • your downloading, sharing, publishing, distributing, commercializing, or otherwise using generated media
  • your violation of these Terms or applicable law
  • your infringement or violation of any third-party rights

Suspension and Termination

We may, in our sole discretion and with or without notice:

  • suspend or restrict access to the Service
  • remove content or disable links
  • delete files or records
  • freeze, flag, or terminate accounts
  • refuse refunds, reverse credits, or cancel subscriptions where permitted by law

You may stop using the Service at any time. Upon termination or suspension, provisions of these Terms that by their nature should survive will survive, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnity, dispute resolution, and enforcement.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction we designate for the Service, without regard to conflict-of-law principles.

Before filing a formal claim, you agree to first contact us at support@zimage.run and attempt to resolve the dispute informally.

If a dispute cannot be resolved informally, we may require that it be resolved by binding arbitration or another dispute-resolution process permitted by applicable law. To the fullest extent permitted by law, disputes must be brought on an individual basis and not as part of a class, collective, or representative action.

Nothing in these Terms prevents either party from seeking injunctive or equitable relief for intellectual property misuse, security incidents, confidentiality breaches, or other urgent matters where permitted by law.

Changes to These Terms

We may modify these Terms at any time. Updated Terms become effective when posted unless we state otherwise. Your continued use of the Service after revised Terms are posted means you accept the revised Terms.
